Lil Wayne Free!
In a report aired Sunday on Atlantas Fox television affiliate, WAGA Channel 5, Lil Waynes lawyer, William Head, explained to Fox 5 reporter Charles Molineaux that the circumstances that led to his clients arrest were just a big misunderstanding.
In August of 2006, Wayne was arrested in Atlanta on drug possession charges (3 counts) and released on a $10,000 bond. But after failing to appear at an all-purpose hearing in the case in August of this year he was declared a fugitive. This past Wednesday, October 3rd, a bench warrant was issued for his arrest.
Head, who is Waynes new lawyer in the case, says that his client has been touring since March, and suggests that any notices demanding that he appear in court and offer an additional $10,000 bond went to Waynes New Orleans home, and therefore went unanswered. Theres no way you would know to be in court, Head explains. In fact, he had a co-defendant who called me himself and said, My case was dismissed. We thought his was too.
Head went on to add, When someone's this successful, there are chances things are gonna fall in the cracks."
Head was able to procure his clients release from the Ada County, Idaho jail - where Wayne spent his Saturday - after filing an emergency release order. Fulton County, Georgia judge Craig Schwall appears to have agreed with Heads argument that his client was not aware of the court proceedings and due to the apparent misunderstanding he should be freed.
Wayne is now free on a $20,000 bond. He is due back in the Fulton County court Tuesday for his arraignment on the charges from 2006. Wayne will spend a good chunk of his week in the ATL, as he attends court on Tuesday and BETs Hip Hop Awards on Saturday.
